Mohun Bagan appoints Dr. Ulrich Haas arbitrator for the Anwar Ali case

​In legal circles, Haas is often associated with what practitioners call the "Haas Doctrine." This refers to his jurisprudential approach emphasising the uniformity of international sports rules. He argues that for global sport to remain fair, rules (especially those regarding doping and transfers) must be interpreted consistently by CAS to prevent "forum shopping" or conflicting national laws



Last Month, Mohun Bagan moved to CAS for the long-pending Anwar Ali case. The CAS asked Mohun Bagan and the other parties to appoint the arbitrators for the proceedings. 

As per recent updates, Mohun Bagan have appointed Sports Law Professor Dr Ulrich Haas, a FIFA RSTP Expert, as the Club's arbitrator.

Who Is Doctor Ulrich

Professor Dr. Ulrich Haas is one of the most influential figures in the global sports law landscape. A dual-national (German and Swiss), he serves as a Professor of Civil Procedure and Civil Law at the University of Zurich and is an Attorney-at-Law in Hamburg. With a career spanning decades, he has transitioned seamlessly between academia and the highest echelons of sports arbitration.

Expertise and Global Influence

​Professor Haas is a cornerstone of the Court of Arbitration for Sport (CAS) in Lausanne. He has acted as a chairman, sole arbitrator, or party-appointed arbitrator in over 400 sports-related proceedings. His influence extends beyond the courtroom; he was a member of the drafting teams for the World Anti-Doping Code (WADC) for the 2015 and 2021 editions and chaired the WADA Governance Reform Group.

​In the world of basketball, he serves as the President of the Basketball Arbitral Tribunal (BAT), overseeing the resolution of financial and contractual disputes globally.

Notable CAS Cases and Arbitration Milestones

​Throughout his tenure at CAS, Professor Haas has been at the helm of some of the most complex and high-profile cases in sporting history. While an arbitrator's role is to remain impartial, his decisions have set significant legal precedents.

1. The Simona Halep Doping Appeal (CAS 2023/A/10025)

Professor Haas was part of the three-member panel that dramatically reduced the doping ban of former world number one tennis player Simona Halep. Initially facing a four-year suspension, the panel—after rigorous review—concluded that Halep bore "no significant fault" for her positive test, reducing her ban to nine months.

2. The Marin Čilić Anti-Doping Case (CAS 2013/A/3327)

Serving as President of the panel, Haas oversaw the appeal of Croatian tennis star Marin Čilić. The panel reduced Čilić's initial nine-month ban to four months, establishing critical interpretations regarding "intent" and "degree of fault" in anti-doping rule violations (ADRVs).

3. FC Sion vs. FIFA (CAS 2009/A/1880)

This landmark case in football involved the Egyptian goalkeeper Essam El-Hadary and a dispute over his transfer from Al-Ahly to FC Sion. Haas’s involvement helped clarify the application of FIFA’s Article 17 regarding the "consequences of terminating a contract without just cause"—a case frequently cited in subsequent transfer disputes.

4. Jakub Świerczok vs. AFC (CAS 2022/A/9334)

As President of the panel, Haas led the decision to set aside a four-year ban imposed on Polish striker Jakub Świerczok. The panel ruled that the player had established the source of a prohibited substance (trimetazidine) as a contaminated product, highlighting Haas’s commitment to procedural fairness and scientific evidence.

5. Olympic Ad Hoc Divisions

Haas has been selected multiple times to serve on the CAS Ad Hoc Division (most notably at the 2010 Vancouver and 2016 Rio Olympics), where arbitrators must render binding decisions on disputes arising during the Games within a 24-hour timeframe.

In the context of a potential legal battle at the Court of Arbitration for Sport (CAS), appointing a veteran like Dr. Ulrich Haas would be a strategic masterstroke for Mohun Bagan Super Giant.

As a world-renowned law professor and one of the most prolific CAS arbitrators (having handled over 200 cases), Haas is known for his surgical approach to the FIFA Regulations on the Status and Transfer of Players (RSTP).

The FC Sion case (which involved the controversial transfer of goalkeeper Essam El-Hadary) is a landmark for the principle of pacta sunt servanda (agreements must be kept). Haas and his colleagues ruled that the player breached his contract without "just cause," leading to significant sporting sanctions.

As the club is involved in a dispute where a player has "walked out" or another club has "poached" talent, Haas's history shows he has a low tolerance for breaches of contractual stability. He is likely to protect the club's rights if the paperwork is solid.

A key takeaway from CAS 2009/A/1880 was how the panel meticulously calculated the USD 796,500 compensation based on the specific "specificity of sport" criteria under Article 17 of the RSTP.

Haas is an expert in the "positive interest" principle—ensuring that the non-breaching party is put in the financial position they would have been in had the contract been fulfilled. For a club like Mohun Bagan, this ensures that any financial damages awarded are fair and legally airtight.

Notably, East Bengal, Anwar Ali, Delhi FC and AIFF have picked Professor Luigi Fumagalli, who is also a very respected name in the World of Sports Law.

Before the Derby on the field in the coming May, the Derby off the field is heating up, as two of the most prominent names are all set to resolve the most controversial transfer saga of Indian Football within the coming few weeks.
